CCPA Directs E-Commerce Platforms to Audit and Eliminate Dark Patterns Within 3 Months

Delhi;- In a major push towards fair digital trade practices, the Central Consumer Protection Authority (CCPA) has issued a formal advisory to all e-commerce platforms in India, directing them to undertake self-audits within the next three months to detect and eliminate dark patterns—deceptive online interfaces that mislead or manipulate consumers.

The advisory, issued as part of the government’s ongoing efforts to ensure transparency and consumer welfare in the digital marketplace, mandates platforms to assess their user interfaces and ensure compliance with the Guidelines for Prevention and Regulation of Dark Patterns, 2023. Based on their audits, platforms are encouraged to submit self-declarations affirming that they do not deploy dark patterns. These declarations aim to promote a trustworthy digital ecosystem for consumers.

The CCPA has already issued notices to certain platforms found in violation of the guidelines, emphasizing its zero-tolerance approach to unfair trade practices. The authority reiterated that dark patterns such as false urgency, basket sneaking, confirm shaming, subscription traps, and other manipulative tactics are strictly prohibited.

To support this regulatory framework, the Department of Consumer Affairs has constituted a Joint Working Group (JWG), including representatives from concerned Ministries, regulatory bodies, National Law Universities (NLUs), and Voluntary Consumer Organisations. The JWG is tasked with identifying violations, advising on corrective measures, and recommending consumer awareness programs.

The 2023 Guidelines specify 13 key types of dark patterns, including:

Bait and Switch

Disguised Advertisements

Nagging

Trick Wording

Rogue Malware

This move reflects the Government of India’s commitment to safeguarding consumers in the rapidly evolving digital economy and enhancing digital fairness and accountability in the e-commerce sector.
